Furniture Lay-By Terms and Conditions

Furniture Roots is committed to making quality furniture more accessible and affordable for customers across Perth and beyond. Our Layby service lets you reserve goods today and pay for them over time in manageable, interest-free instalments, before delivery. We’ll only dispatch your order once the final payment has cleared.

Interest‑Free Instalment Plan

Choose equal monthly payments over a period up to 12 months. No interest applies. If you miss a payment, a late fee of $50 applies per missed instalment. Continued non-payment may involve a debt collector, which can affect your credit rating.

Eligibility & Verification

To open a Layby, you must be at least 18 years old and live in Australia. Please provide these details for verification:

  • Full name
  • Residential address
  • Email address
  • Mobile phone number

Payment Terms & Options

These payment details are clearly outlined in your layby agreement, as required by consumer law.

  • Minimum purchase: $150 (including GST).
  • Deposit: 10% of purchase price, due within 7 days of placing the lay-by (no setup fee).
  • Payment methods: All major credit cards accepted. We also offer electronic funds transfer (EFT) on request.
  • Receipts: After each payment, you receive a registered receipt showing the amount paid and remaining balance.
  • Payment frequency: You may pay more than once per month if that helps you stay on schedule.

Lay-by Agreement Parties & Responsibilities

The lay-by agreement is between Furniture Roots and you (the person initiating the lay-by, the “Lay-by Contact”).

You alone are responsible for making all payments and complying with these terms. Please note that until the lay-by is fully paid and finalised, the products remain the property of Furniture Roots.

Furniture Roots does not guarantee any item until your application is complete, payment is finalised, and our team approves the order.

Lay-by Commencement & Finalisation

  • Date Placed: The day you submit your order (shown on your receipt) starts the Agreement.
  • Deposit Due: You must pay a 10% deposit (of the total purchase price) within 7 days of placing your order to activate the layby; if you do not, the layby will be cancelled.
  • Finalisation Date: Set once all instalments are paid. After you make the final payment, we will arrange delivery or collection of your order within a reasonable timeframe.

Note: We cannot store your order longer than 30 days after your complete payment, unless we have made prior arrangements with you. If you fail to pick up or accept delivery within 30 days of notification, additional delivery or storage fees may apply.

Lay-by Duration & Amendments

  • Duration: Our layby plans run for up to 52 weeks, with regular monthly payments expected throughout the term.
  • No changes: The items on your layby order must remain as a single package: you cannot add, remove or split items from a layby once it is confirmed.
  • Early pickup: When it’s time to collect, all items in your layby must be picked up together as one order. If you wish to collect the goods before the layby end date, you must tell us at least 12 weeks in advance and pay the remaining balance in full.
  • Address changes: It is important to keep your details current. If you move house after setting up your layby, please inform us so we can adjust delivery charges.

Note that layby is only available for in-store purchases of full-priced items. Sale items and online-only purchases cannot be placed on layby.

Warranty Period

All product warranties start from the date you collect the items (not from when the lay-by began). Note that lay-by terms may vary for special events or promotions.

Privacy Information

We use your personal information to manage the lay-by and send payment reminders by mail, SMS, or email, from Furniture Roots or our third-party service providers.

Furniture Roots only shares your personal details with trusted service providers when necessary to manage your Layby agreement.

Return & Refund Policy

You may cancel or return any layby order within 48 hours of placing it, subject to a 50% restocking fee (based on the purchase price).

Exclusions: Custom-made items (e.g. special colours, sizes, fabrics) and sale items cannot be returned, exchanged or refunded once you place the order or pay the deposit.

Customer’s Right of Cancellation

You have the right to cancel your layby at any time before you collect the goods (this does not apply to custom-made orders). In the event of cancellation by you, Furniture Roots will refund all payments you have made minus a $250 cancellation fee and a 50% restocking fee of the item’s purchase price.

These cancellation terms comply with Australian consumer law, which allows customers to cancel layby agreements and requires businesses to refund deposits (less any agreed cancellation fee).

Company’s Right of Cancellation

Furniture Roots may also cancel your layby under certain conditions:

  • Missed payments: If you fail to meet the payment schedule, Furniture Roots may cancel the lay-by. In that case we will charge a termination fee plus a 50% restocking fee on the products.
  • Supply issues: Furniture Roots can cancel if we cannot supply the item (for example it is discontinued or found to be faulty), or if we cease trading. In these cases, no termination fees apply.

Termination & Liability Terms

Furniture Roots reserves the right to terminate the layby agreement if you seriously breach its terms or engage in illegal conduct, to the extent allowed by law. Under the Australian Consumer Law (ACL), consumers have certain non-excludable guarantees which we fully honor. This layby agreement does not override your ACL rights or any other legal rights that cannot be excluded.

Subject to the ACL and other mandatory laws, Furniture Roots excludes all other liabilities related to the layby agreement. If the item is not used primarily for personal or household purposes, our liability is limited (as the ACL allows) to supplying the service again or covering its cost. Unless required by law, Furniture Roots is not responsible for any indirect or consequential losses that may arise in connection with the layby.

In essence, all Furniture Roots Layby sales comply with the Competition and Consumer Act 2010 (Cth). You retain all legal consumer rights under this law. We are committed to abiding by those laws. Our own layby terms are designed to be fair and transparent. If any conflict arise, the Australian Consumer Law (as part of the Competition and Consumer Act 2010) will take precedence over any business policy.
